Regulatory status
FINTRAC – money services business
FINTRAC's public Money Services Business Registry lists BANIFI PAYMENTS LTD., Ontario corporation number 1001254349, as Registered under MSB number N300001254. SA North Ltd. is the company's current name; the registry entry is published under its former name, Banifi Payments Ltd.
FINTRAC registration is a legal requirement for MSBs under the Proceeds of Crime (Money Laundering) and Terrorist Financing Act. It is not a licence, and it does not mean that FINTRAC endorses SA North Ltd. or its services.
Provincial requirements
SA North Ltd. does not currently offer its services to clients located in Quebec. Services that require a licence under Quebec's Money-Services Businesses Act will be offered there only after the licence has been obtained from Revenu Québec.
Services
SA North Ltd. provides, to eligible business clients:
multi-currency payment accounts;
foreign exchange;
domestic and international transfers through local and international payment systems.
The exact services, currencies and corridors available to you are confirmed in your client agreement after onboarding. Services are available only where the applicable registrations and other requirements are in place.
Who can use the services
Services are offered only to businesses and institutional clients. They are not offered to individuals acting for personal, family or household purposes.
Every client must pass SA North Ltd.'s identity verification (KYC/KYB), sanctions screening and risk assessment. SA North Ltd. may decline or end any relationship.
Services are not available in jurisdictions where SA North Ltd. is not permitted to provide them, to persons subject to Canadian or other applicable sanctions, or for activities prohibited by our client acceptance policy.
Important notices
SA North Ltd. is not a bank. Payment accounts are not deposit accounts, do not earn interest unless agreed in writing, and are not insured by the Canada Deposit Insurance Corporation (CDIC) or any other deposit-insurance scheme.
Foreign exchange rates move. The rate and fees that apply are shown to you before you confirm a transaction.
Nothing on this website is an offer, solicitation or financial, legal or tax advice.
Beware of fraud. SA North Ltd. writes to you only from @swissarca.com addresses, never asks for your passwords or one-time codes, and never asks you to pay to an account other than one confirmed in your agreement. Report suspected impersonation to compliance@swissarca.com.

1. Who we are

FINTRAC's registry lists the company under its former name, Banifi Payments Ltd., as Registered under MSB number N300001254. FINTRAC registration is not a licence or an endorsement. 2. Scope
These terms govern your use of this website. By using it, you accept them. They do not govern any payment or foreign-exchange service. Those services are provided only under a separate written client agreement with SA North, which prevails over these terms if the two conflict.
3. Intended audience
The website is intended for businesses and institutional clients. It is not directed at individuals acting for personal, family or household purposes, at anyone in Quebec, or at anyone in a jurisdiction where its content or our services would be unlawful or would require a licence or registration we do not hold.
4. No offer and no advice
The content is general information. It is not an offer, a solicitation or a commitment to provide any service, and it is not financial, investment, legal, tax or accounting advice. Exchange rates, fees, currencies and corridors shown or described are indicative examples and may change. The terms that apply to you are confirmed only in your client agreement and before each transaction.
5. Enquiries
Sending an enquiry does not open an account, create a client relationship or oblige us to provide any service. All clients must complete our identity verification, sanctions screening and risk assessment, and we may decline any enquiry without giving reasons where the law requires or allows it.
6. Acceptable use
You may use the website only for lawful purposes. You may not:
attempt to gain unauthorised access to the website or its systems;
interfere with its operation or introduce malicious code;
copy or scrape its content systematically;
use it to impersonate SA North or to mislead others about our services; or
use it in connection with fraud, money laundering, terrorist financing or sanctions evasion.
7. Intellectual property
The content of the website, including text, graphics and the SA North and Swiss Arca names and logos, belongs to SA North, Swiss Arca AG or their licensors. You may view and print pages for your own internal business use. Any other use requires our prior written consent.
8. Links
The website links to the websites of other Swiss Arca Ecosystem members and third parties. Each is operated by its own entity under its own terms. We are not responsible for their content or practices.
9. Accuracy and availability
We take care to keep the website accurate and available but do not guarantee that it is complete, up to date or free of errors or interruptions. We may change or remove content at any time.
10. Limitation of liability
To the fullest extent permitted by law, SA North is not liable for any direct, indirect or consequential loss arising from your use of, or inability to use, the website or from reliance on its content. Nothing in these terms limits liability that cannot be limited by law, including for fraud, gross negligence or intentional misconduct.

13. Governing law and jurisdiction
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. The courts of Ontario sitting in Toronto have exclusive jurisdiction, subject to any mandatory rules of law. These terms are drawn up in English.
